In General

Mental Health America of Greenville County (“MHAGC”) is a nonprofit corporation and owns and operates this Website. This document governs your relationship with MHAGC and mhagc.org (“Website”). Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

This Website may contain links to other websites (the "Linked Sites"), which are not operated by MHAGC. MHAGC has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site

Privacy Policy

Our privacy policy, which sets out how we will use your information, can be found at MHAGC Privacy Policy. By using this Website, you consent to the processing described therein and warrant that all data provided by you is accurate.

Prohibitions

You must not misuse this Website. You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Any attempt to access restricted areas without authorization is prohibited. Breaching this provision would constitute a criminal offense and MHAGC will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Intellectual Property, Software and Content

The intellectual property rights in all software and content (including photographic images) made available to you on or through this Website remains the property of MHAGC or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by MHAGC and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

Terms of Sale and Donation

In order to use mhagc.org you must be 18 or operating under the supervision of your parent or legal guardian. By placing an order you are offering to purchase a product or make a donation on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Any payments of donations are final and nonrefundable. You may choose to create a Donor Account but are not required to do so in order to donate.

Mental Health America of Greenville County is a non-profit corporation, tax exempt under section 501 (c) (3) of the Internal Revenue Code of the United States of America (US). Donations made in US Dollars by US tax payers are tax-deductible to the full extent permitted by law. Our tax ID number will be included on your receipt for your donation. Event registrations are not eligible for deduction.

Images of items for donation such as those for Operation Santa or Colors 4 Hope and all others are for illustration purposes only and may not depict the actual items acquired with donated funds. By making a donation you warrant that the mechanism that you use (credit card or otherwise) is owned by you or you have permission to use it, and that there are sufficient funds to cover the cost of the goods or donation. When you make a donation your donated funds are charged to your credit card and transferred to MHAGC's PayPal account. Purchases are charged and transferred in the same manner. Donations are made as unrestricted gifts and are not considered to be specified for any particular purpose, with the exception of donations made through the Funds 4 Hope portion of mhagc.org. Since Funds 4 Hope donations are specified for certain purposes MHAGC takes seriously your designation of how you wish your donated funds to be used and will make a good faith effort to use your donated funds as you direct, i.e., to buy socks, combs, color for Colors 4 Hope races and more, but may reallocate donated funds to the area or program of greatest need if necessary. As an example, if Operation Santa needs 400 pairs of  socks and 400 combs, and the need for 400 pairs of socks is met, we may reallocate further funds donated for socks to be used to purchase other items, such as combs or deodorant, etc. Any such reallocated funds will be used with respect to our mission to promote positive mental health for all persons in our community through advocacy, education and service. You as the donator pledge not to seek any reciprocal favors from MHAGC, on the basis of your donation.

Colors 4 Hope merchandise purchased by race participants such as additional T-shirts, color, etc. will be picked up by the participant on the day of the event at the race site. A complementary T-shirt and packet of color are included in the race packet which participants or their designated representatives pick up at a location to be announced, a day or days prior to the Colors 4 Hope race.

Colors 4 Hope merchandise and other merchandise purchased in the Funds 4 Hope portion of mhagc.org is subject to availability.

Disclaimer Statement

MHAGC’s website is for informational purposes only and is not meant to serve as medical advice or to replace consultation with your physician or mental health professional.

Use of MHAGC’s website constitutes an agreement by the users not to hold MHAGC or any of its employees or officers liable or responsible for information posted to discussion boards and other forums or personal fundraising pages by persons or entities not associated with MHAGC.

You acknowledge that the information on the Website is provided "as is" for general information only. It is not intended as medical advice, and should not be relied upon, as a substitute for consultations with qualified health professionals who are familiar with your individual medical needs.

This site includes personal fundraising campaigns and donor accounts. When you operate a campaign or a donor account, you agree to abide by all these Terms and Conditions. We want our Community to be a safe, comfortable, and friendly environment. We can remove any messages, images or solicitations that do not meet the standards of these Terms and Conditions. MHAGC reserves the right to immediately terminate a user's registration if we become aware and determine that the user is violating any of these Terms and Conditions.

Commercial solicitation, chain letters, junk mail, "spam", non-commercial or bulk solicitation is prohibited.

Threatening harassing, libelous, defamatory, vulgar, profane, obscene, abusive, harmful, sexually oriented, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature, is prohibited.

Unlawful material, or any material that encourages or promotes conduct that constitutes a criminal offense, or might give rise to civil liability or otherwise violate any applicable local, state, Federal or international law or regulation, or encourage the use of controlled substances, is prohibited. Posting content or participating in any form of discussion with the intention to commit any illegal activity is strictly prohibited.

Limitation of Liability

You agree that you will hold harmless MHAGC and its officers, directors, employees, and volunteers from all claims arising out of or related to your access or use of, or your inability to access or use, this Website or the information contained in this Website or other websites to which it is linked. This includes, but is not limited to, information or materials viewed or downloaded from this Website or another website to which it is linked that appear to you or are construed by you to be obscene, offensive, defamatory, or that infringe upon your intellectual property rights. In no event will MHAGC or the contributors of information to this Website be liable to you or anyone else for any decision made or action taken by you in reliance on such information or for any consequential, special or similar damages, even if advised of the possibility of such damages.

Endorsements

You acknowledge that the opinions and recommendations contained in this Website are not necessarily those of MHAGC or endorsed by MHAGC. MHAGC may provide links on the Website to other websites which are not under the control of MHAGC. In general, any website which has an address (or URL) which does not contain "mhagc” is such a website. These links are provided for convenience of reference only and are not intended as an endorsement by MHAGC of the organization or individual operating the website or a warranty of any type regarding the website or the information on the website.

Content Usage Policy

Unless otherwise indicated, all information contained on our website mhagc.org or in written form including but not limited to text, graphics, logos, button icons, video or audio clips is copyrighted by and proprietary to MHAGC and may not be copied, reproduced, transmitted, displayed, performed, distributed, sublicensed, altered, stored for subsequent use or otherwise used in whole or in part any manner without MHAGC’s prior written consent, except that the user may make such temporary copies in a single computer’s RAM and hard drive cache as are necessary to browse the website, and the user may make one permanent copy of each page of the website, brochure or booklet to be used by the user for personal and noncommercial uses which do not harm the reputation of MHAGC.

Once written consent is given in the form of a signed permission agreement, the following restrictions apply:

  • The content may be used for informational, non-commercial purposes only
  • Any copy of content or portion thereof must include Mental Health America of Greenville County cite line as “copyrighted and published by Mental Health America of Greenville County, no part of this document may be reproduced without written consent”
  • MHAGC has the right to revoke such authorization at any time, and any such use must be discontinued upon notice from MHAGC.

Linking Your Website to MHAGC.ORG

MHAGC is dedicated to promoting mental health, preventing mental disorders and achieving victory over mental illness through advocacy, education, research and service. MHAGC therefore encourages and permits links to MHAGC’s website that support this mission. As such, MHAGC allows external, hyper-text links to websites, provided:

(a)
any text-only link must clearly be marked "Mental Health America of Greenville County";

(b)
the appearance, position and other aspects of either the link or the host website may not be such as to damage or dilute the goodwill associated with MHAGC’s name and trademarks;

(c)
the appearance, position and other aspects of either the link or the host website may not create the false appearance that an entity other than MHAGC is associated with or sponsored by MHAGC;

the link, when activated by a user, must display this Website full-screen and not with a "frame" on the linked website. MHAGC considers framing, the practice of intact reproduction of a page or pages of one website to another website, to be deceptive and a violation of MHAGC’s copyright rights. MHAGC Website Linking to External Websites

MHAGC is a nonprofit corporation dedicated to promoting positive mental health for all persons in our community through advocacy, education and service. MHAGC is also committed to presenting material in a nonpartisan, noncommercial manner. Thus, links to MHAGC’s website should not be used for inappropriate, political or commercial purposes, or suggest that MHAGC promotes, endorses or sponsors any third party’s causes, ideas, products or services. Additionally, MHAGC is not responsible for the information or materials contained on the host website. Links to external websites are provided for convenience of reference only and are not intended as an endorsement by MHAGC of the organization or individual operating the host website or a warranty of any type regarding the host website or the information on the host website.

Privacy Policy Statement

For each visitor to our Web page, our Web server automatically recognizes the consumer's domain name/IP Address, the e-mail addresses of those who have created Donor Accounts or Funds 4 Hope Campaigns (Fundraisers 4 Hope), the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, information volunteered by the donors, Fundraisers 4 Hope, or other visitors, such as survey information, e-mail addresses, telephone numbers and/or site registrations. We automatically collect only the domain name/IP Address.

If you are under 18, you may use mhagc.org only with involvement of a parent or guardian.

You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to notify MHAGC immediately of any unauthorized use of your account or password, or any other breach of security. However, you will be responsible for losses incurred by MHAGC or any other user of the Services due to someone else using your MHAGC ID, password or account.

If you do not want to receive e-mail from us in the future, please let us know by writing to us at unsubscribe@mhagc.org.  If you supply us with your postal address on-line you will only receive the information for which you provided us your address. Persons who supply us with their telephone numbers on-line will only receive telephone contact from us with information regarding donations or purchases they have made on-line. The information we collect is used for marketing purposes, internal review, used to improve the content of our Web page, but is not shared with other organizations for commercial purposes.

Cookies: To help make our sites more responsive to the needs of our visitors, we invoke a standard feature found in browser software, called a "cookie", to assign each visitor a unique, random number, a sort of anonymous user ID that resides on your computer. A cookie can't read data off your hard drive. You can disable cookies at any time by changing the preferences in your browser.

For our internal purposes, we gather date, time, browser type, navigation history and IP address of all visitors to our site. This information does not contain anything that can identify users personally. We use this information for our internal security audit log, trend analysis and system administration, and to gather broad demographic information about our user base for aggregate use.

Recognition

Sponsors may be recognized on the MHAGC website and may include the sponsor logo, link to the sponsor website, and a brief overview of the sponsor's chief business activity. Internet-based sponsorship recognition will generally be limited to a sponsor section of the website but may also include, in certain circumstances, recognition on the site's homepage and in other prominent areas.

The following guidelines will apply:

  1. Sponsors may post MHAGC's logo and a link to www.mhagc.org on the sponsor website. The logo use must conform to our Branding Guidelines and any requirement set out in written agreement.
  2. MHAGC does NOT endorse companies, products or services and strictly prohibits the suggestion of endorsement, recommendation, or superiority of one company, product or service over another company, product or service.
  3. A Sponsor's logo and link may not reside on MHAGC program-related pages, with the exception of general fundraising activities such as Colors 4 Hope.
  4. When MHAGC's web site includes links to other sites, MHAGC does not assume any responsibility or liability for any communications or materials available at the sites to which it links, including responsibility or liability for their accuracy. No link on MHAGC's website is a referral or endorsement of either the linked-to entity or any product or service.
  5. MHAGC will provide links from its site to others where there is mutual benefit, either formalized in an agreement or by an informal understanding.

With respect to ad servers: We do not partner with or have special relationships with any ad server companies.

If our information practices change at some time in the future, we will post the policy changes to our Web site to notify you of these changes and provide you with the ability to opt out of these new uses. If you are concerned about how your information is used, you should check back at our Web site periodically.

Upon request, we provide site visitors with access to contact information (e.g., name, address, phone number) that we maintain about them and users have the right to opt out of having their information collected. Consumers can do this by writing to us at the address below.

With respect to security: MHAGC uses a Secure Sockets Layer (SSL) connection to your computer in order to safeguard sensitive information such as your email address, login password, address or phone number. We do not collect credit card information but instead all transactions are handled through PayPal, again over SSL.

All information provided by individuals to MHAGC is confidential, unless otherwise noted. Information is never sold or traded. If MHAGC wishes to use any information provided, the provider will be contacted, and a release form outlining its use will be provided. Individuals retain the right to request Mental Health America to remove their information from all mailings, both online and on paper at any time.

Variation

MHAGC shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Applicable Law

By visiting mhagc.org, you agree that the laws of the United States of America, without regard to principles of conflict of laws, will govern these Terms and Conditions of Use and any dispute of any sort that might arise between you and MHAGC.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and MHAGC. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of MHAGC.
